The person who, according to the label of a sealed package of food or cosmetic, imported, manufactured or packed it is presumed to have done so and is liable for non-compliance (Act 54 of 1972, s. 9), so the importer, manufacturer or packer named on pack is the accountable party.
Food labels are read against R146 of 1 March 2010 (amended by R1091 of 2010 and R45 of 2012), made under Act 54 of 1972, which defines a label as any mark or descriptive matter on or packed with a foodstuff or cosmetic.
It is an offence to describe a foodstuff or cosmetic for sale in a manner false or misleading as to its origin, nature, composition, quality, nutritive value or other properties, or to publish a false or misleading advertisement (Act 54 of 1972, s. 5); R146 governs labelling and advertising claims for food.
